Please read and respect the terms and conditions of sale before any subscription. General Conditions of Sale SAS TAKA CORP.


1. Preamble


These general conditions of sale govern the contractual relations between SAS TAKA CORP, whose registered office is at 4 rue de Melun 77515 Saint-Augustin (hereinafter referred to as "SAS TAKA CORP ") and his client. SAS TAKA CORP reserves the right to modify and update these terms and conditions at any time without notice.

By placing an order, the customer declares to have read these general conditions of sale and expressly accept the terms without reservation.


2. Products


All our products are collectible figurines, they are not toys, they are intended for 14 years old and over.

All our pieces are made in limited edition.

The figurines offered for sale are those presented on the website of SAS TAKA CORP in the limit of the available stock.

Descriptions, information and photographs showing the figures, are a reproduction more exact as possible but are provided for illustrative purposes and have no contractual value.

In order to constantly improve the quality of its products, SAS TAKA CORP can be caused to have to modify the characteristics of its products.


3. Preorder-Order


The sale is deemed concluded upon confirmation of the order by SAS TAKA CORP. In case of out of stock, SAS TAKA CORP will notify the customer as soon as possible. Which in this case, the order will be automatically canceled and any money paid will be refunded.

For all products marked "pre-order", you have the opportunity to book them before official release. By passing pre-order, the customer indicates his intention to order the product before it is available. For these products, the availability date is only indicative.

SAS TAKA CORP reserves the right to refuse or cancel any order from a customer in case of unpaid invoice or insolvency.


4. Deposit


Any order implies the payment of a deposit equal to 10% of the selling price.


5. Cancellation


The order or pre-order is subject to cancellation by the customer, as long as the product has not yet been shipped.

The deposit of 10% of the purchase price is not refundable.

The price of the order, less the deposit, is refunded via the same customer's initial payment method. If the customer's bank card expires, the refund can be made by bank transfer.

Any financial costs generated by the reimbursement will be borne by the customer.


If within 15 months the customer has not been able to pay the amount due despite the payment solutions offered, SAS TAKA CORP reserves the right to cancel the order and refund the amount already paid by the customer. without prior delay.

Taka Corp SAS reserves the right to choose the refund method.


6. Right of withdrawal


For any order placed online over the internet, the customer has the right to withdraw in writing or on any other durable medium, without indication of reason and without penalties, within 14 days calendars, from the day of receipt of the product. If the last day of the deadline is not a day the deadline is extended to the next working day.

In the event of exercise of the right of retraction, the customer will be refunded of the sums perceived by the SAS TAKA CORP including, where applicable, delivery charges, with the exception of return charges and this 14 days after SAS TAKA CORP has been informed of the client's decision to retract.

SAS TAKA CORP however reserves the right to defer payment until receipt and product verification.

7. Delivery


After confirmation of the order, all available products are delivered at the latest in the 30 days after the date on which the order is confirmed, subject to the full payment of the price.

For pre-ordered products, they are delivered as soon as they are in stock. The availability date indicated on our site is only indicative. The customer will be notified of the delivery date by email.

Additional delivery costs to those paid in the initial order may apply  at the time of shipments.


8. Guarantee of hidden defects


In order for the customer to implement the hidden defects guarantee, the defect affecting the product must in particular be prior to the purchase / sale agreement and render the Product unfit for use for which it is intended. The customer can not act as a guarantee against hidden defects if he had knowledge of the defect affecting the product, it being specified that the apparent nature of the defect is assessed when delivery, and that the quality / competence of the customer is taken into consideration for the determination of his knowledge of vice. SAS TAKA CORP does not guarantee hidden defects when there is a faulty use of the Product. 9. Price


The prices indicated in our catalog are expressed in euros, all taxes included, excluding shipping costs to France and some neighboring countries (Belgium).

Delivery charges may apply on certain products to France and Belgium for orders under 50 euros including tax. For deliveries to other destinations, the shipping costs are expressed by selecting the country of destination. Any customs fees, or any other taxes are the responsibility of the customer.


10. Method of payment


The price is payable cash on the day of the order, by way of secure payment, according to the payment methods offered on our website.

If payment has been refused by the issuing body of the payment card, SAS TAKA CORP will automatically cancel the order. The customer will be notified by email and will have to place a new order.

The customer has the obligation to pay the full price when registering any order. If there is pre-order, the customer has the obligation to pay the deposit and the balance of the price, possibly in three (3) deadlines, without expenses, if he opted for this possibility, at the time of the registration of his Pre-Order. VAT is applied in compliance with the law and regulations in force in France. The invoice (s) issued by SAS TAKA CORP for the settlement of the price takes into account, if there is Pre-Order, the deposit that has been settled. The payment of the price is done by credit card (Carte Bleue, Visa card, Eurocard / Mastercard). Payments are made in euros, subject to good collection. All taxes and all general expenses (such as, and without this list being exhaustive, bank charges, collection fees, exchange fees, customs fees, collection costs) are the sole responsibility of the customer ( " Fresh "). Only transport costs and delivery costs of the product outside mainland France are the responsibility of the customer.

As such, unless otherwise expressly confirmed by the customer on the website of SAS TAKA CORP, at the time of registration of the Order or Pre-Order, it is a standard shipping and delivery charges that will be invoiced to the customer. The customer can expressly opt for a non-standard and more expensive delivery method (private, express or faster). The customer has the obligation to pay the price and the costs without having the right to proceed unilaterally to any compensation or reduction, withholding or suspension, of any nature and for any reason whatsoever.


11. Litigation


This contract is subject to the application of French law. In case of dispute, only the French courts are competent. Disputes that may arise concerning the validity, interpretation, execution, non-performance, interruption or termination of the General Conditions, any Special Conditions and any contract, document , an agreement concluded between SAS TAKA CORP and the customer will be negotiated between them to define the most suitable amicable solution. Any Customer has the right (and not the obligation), in case of dispute with the SAS TAKA CORP, to seize for free (except any possible personal expenses of lawyer or expertise) the mediator of the consumption chosen by SAS TAKA CORP and approved by the Commission for Evaluation and Control of Consumer Mediation. The terms of referral of said consumer mediator are detailed on his own website. Thus, in particular, it is recalled that the client can only seize the consumer mediator if he has previously tried to resolve the dispute with SAS TAKA CORP by means of a written complaint. The Customer has a period of one (1) year after his written complaint to SAS TAKA CORP to seize the consumer mediator. If the solution proposed by the mediator of consumption is not accepted by SAS TAKA CORP and the client, the most diligent party has the right to submit the dispute to the competent courts. In this case, the disputes will be submitted to the exclusive jurisdiction of the courts of the jurisdiction of the Court of Appeal of Paris, notwithstanding the possible plurality of defendants, the incidental claims in forced intervention or appeal in warranty.


12. Retention of title


Products delivered to the customer are transferred to him with retention of title. The transfer of ownership is subject to full payment of the price by the customer. 13. Limitation of liability

15. Protection of personal data


By placing an order, the customer agrees that SAS TAKA CORP processes, collects and uses his personal information. The collection of this information is necessary for the processing of orders, payments and the smooth running of commercial relations between SAS TAKA CORP and the customer. These data are not disclosed to third parties.

SAS TAKA CORP is not responsible for any data, information or documents transmitted to it or communicated, by any means whatsoever, by the customer. By the simple fact of having received them, SAS TAKA CORP can not be presumed to have accepted them.

SAS TAKA CORP processes the information communicated to it by the client in accordance with the principle of confidentiality.

The customer may, at any time, request that his data are no longer collected, processed or used for the purposes listed above, or request rectification of his data by contacting SAS TAKA CORP.


16. Customer Service


For any complaint or request for information, SAS TAKA CORP remains at your disposal 5 days a week from Monday to Friday with French opening hours.
